RealWay Australia Pty Ltd and its independently owned RealWay Licensee Offices deliver a wide range of real estate services and products to customers and clients. In doing so it produces and sends out direct marketing materials to our customers and clients who have agreed to receive this information. The RealWay Independently owned offices also produce and send out updated and news materials to prospective clients but does not use personal information collected in an unfair and non-transparent manner. If this information is made available to us via a third-party supplier to the RealWay group or directly to the independently owned licenced office, it is only potentially used if the prospective client has previously agreed for this third-party supplier to make their personal information available to all their real estate clients (including RealWay agencies and personnel).
Realway privacy principles
RealWay Australia and the independently owned licenced offices and their personnel adhere to the Principles set out in the Privacy Act 1988 (CTH) including the Privacy Amendment (Enhancing Privacy Protection) Act 2012 with the object of insuring entities with access to personal information must manage personal information in an open and transparent manner as outlined in the relevant government Act and Amendments.
What is “personal information”?
Personal information is any information about you that identifies you or information by which your identity can be reasonably determined as well as additional information required and any records of RealWay’s dealings with you.
Collecting personal information
The collection of your personal information is necessary for RealWay to be able to provide you with our services.
We collect personal information for the purposes of
Providing our real estate products and services as a current or potential client including the sale or purchasing of property, the leasing or renting of property etc. or any other services agreed with client in regards to transactions relating directly to real estate activities or such associated services requested and authorised by the client such as mortgage providers, legal services, building service providers, surveyors, valuers etc.
Giving you the option of receiving our marketing materials in an electronic and or non-electronic format
If we do not collect and make use of your personal information, we are unable to provide you with our services. Generally, we collect your personal information directly from you in the course of providing products and services to you. Information about you must only be collected by lawful and fair means and will only be used for the purposes of this agreement. Registering as a RealWay client grants permission to collect your personal information from yourself and use it as required to provide our products and services. Information may also be collected from you on a day to day basis for the purposes of providing you with our services now or in the future. Any personal information received by RealWay provided by you or not provided by you but in accordance with the APP will be treated in accordance with the APP.
Requesting to not receive marketing material
From time to time we may use your personal information to provide you with information about our products and services. If you are not a client or do not want to receive any of this information, just contact us by phone or email. Once you have advised you no longer wish to receive information about our products or services, RealWay will not send you further material but this not necessarily mean we do not retain your personal information provided by you for the provision of other real estate products or services now and in the future. You can change your mind about receiving information about our products or services at any time. Where it is deemed reasonably necessary or impracticable not to do so according to the APP legislation and or as required by law we may retain this information in a format according to and compliant with the APP.
Dealing with us anonymously
You have the option of not identifying yourself unless by law you are required to do so or it is impracticable not to. If you inquire about our products and services, you do not need to provide your personal details.
Disclosure of your personal information
RealWay may disclose your personal information in certain circumstances. Sometimes we are required or authorised by law to disclose your personal information to other real estate agents. We may also disclose your personal information where you have consented to us doing so. This may be done in writing or verbally. RealWay require written not to be made of such disclosure and use.
Information is up-to-date
It is important that the personal information we collect from you is accurate, complete and up-to-date. You can contact us at any time to access or update your personal information or to tell us that the information we hold about you in inaccurate or incomplete and we will alter our records to reflect these changes.

RealWay takes all reasonable precautions to safeguard your personal information from loss, misuse, unauthorised access, modification or disclosure. For example,
Collected information can be held on our secure internal servers or secure cloud-based servers and authorised third party software providers. In all instances all reasonable steps are taken to ensure the security of this information on these devices.
Restricting access to your personal information only to those personnel required in the conduct of their employment duties and / or for providing you with products and services requiring this information
When your personal information is no longer required it is deleted from our systems in a secure manner when it is practical and reasonable to so or required to be retained by law. You may request access to any of your personal information RealWay holds in writing and we must respond within 30 days in accordance with the APP.
